Welcome to the Cityjet Web site. It is owned and controlled by Cityjet Limited trading as Cityjet (referred to in these Terms as "We", "Our" and "Us". You are referred to in these Terms as "You" or "Your").
PLEASE REVIEW THESE TERMS AND CONDITION OF USE ("Terms") CAREFULLY AS THEY GOVERN YOUR ACCESS TO, AND USE OF, THE WEB SITE.
We may vary the terms from time to time, so you should check the Web site from time to time to make sure you are aware of the latest version. Your continued use of the Web site will be deemed to indicate your acceptance of the latest version of these terms.
By visiting our Web site and/or using any of the features of the Web site you agree to be bound by these terms and condition.
1. Capacity and Indemnity
You represent and warrant to Us that the information You provide in the booking form is accurate, that You are at least 18 years of age and that You have the legal right, capacity and ability to enter into this agreement. You will be responsible for all charges made in respect of the booking. For clarification, Cityjet does permit bookings to be entered into by individuals less than 18 years of age and individuals less than 18 years of age are not eligible to make a booking. You agree to indemnify, defend and hold Us, our affiliates, directors, employees, licensors and suppliers harmless from any claim, demand or damage (including reasonable legal fees) related to your breach of these Terms.
2. Proprietary rights to the Web site
All trade mark, copyright, database rights, and other intellectual property rights in material contained in, or referred to, on this Web site (as well as the layout and organisation of this Web site and its underlying code) belong either to Us or to Our licensors or suppliers. You may not without our prior written permission copy, reproduce, download, republish, extract, broadcast, transmit, display, modify or re-use any of the materials on or underlying this Web site for any purpose other than your personal non-commercial use. You must not modify, vary, obscure or delete any copyright or other proprietary notice from any copies that are so made.

4. Privacy
Any information obtained via this Web site will be used for the purposes of carrying out bookings and communications with You in respect of bookings, other services or special offers offered by Us. The information You provide allows Us to process your flight booking and to send through your flight itinerary and tickets by post and an e-mail confirmation. The inclusion of your telephone contact is vital in the event of a problem with your reservation. The information that You provide to Us is protected by secure software that encrypts all information that is input before it is sent to Us. This encryption ensures that the information is reasonably protected against unauthorised interception. We may also use 'cookies', or other forms of information software, to obtain information from visitors to Our site. The information obtained by these means is not personal information, but it does allow Us to improve the experience of visitors to Our Web site. You should, if You wish, be able to prevent the use of this software by changing the setting on your browser.

6. Payment
You may pay by means of any of the credit or debit cards listed on the booking form. When You purchase flight online You will do so through a secure server. Cityjet use the latest Secure Socket Layer (SSL) technology. Your card details will be encrypted to maximise payment security. If your browser supports SSL, please select the Secure Mode option when confirming your booking and your credit card and other personal information will be protected by SSL. If your browser doe not support SSL then You can Us the Non-Secure Mode but We recommend that You upgrade to the latest version of any browser to ensure that You personal information is afforded the best protection.
7. Liability
A binding contract in relation to a ticket is not formed until Cityjet accepts a customer's offer to buy a ticket. An offer will be deemed to have been accepted by Cityjet once the customer is in receipt of a booking confirmation. Prices are subject to change at any time before acceptance by Cityjet. All flights and products are offered subject to availability. Notwithstanding the foregoing, in the event of a genuine Web site error or inaccuracy, Cityjet reserves the right to withdraw an offer immediately and without notice. Cityjet reserves the right to cancel all confirmed bookings that are subject to genuine Web site error or inaccuracy. In the event of such cancellation Cityjet's only liability shall be to refund the ticket price paid by You. You agree that this is fair and reasonable in the circumstances and your continued use of the Web site indicates your agreement with this specific provision.
8. Conditions of Carriage
The carriage of passengers and their baggage is subject to the provisions of the Warsaw Convention amended by The Hague Protocol 1995, national legislation and Our general conditions of carriage - flying with Cityjet. Please click here to read.
9. Disclaimer
While We have taken all reasonable care in the creation, selection and assembly of Web site content, all such content (including any third party information, products, services or materials) is provided on an "as is" and "as available" basis without warranty of any kind and is subject to change at any time without notice to You. To the fullest extent permitted by law, We disclaim all representations and warranties (express, implied and statutory) in respect of or with regard to the information, products, services and other content (including third party information, products, services and content) included in or accessible from this Web site. 10. Governing Law and jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Ireland and the parties submit and agree to the exclusive jurisdiction of the Irish Courts. Notwithstanding the aforementioned, Cityjet retains the sole right to pursue any suit, claim or proceeding in any jurisdiction that it deems necessary to enforce its rights under these Terms. If any provision of these Terms is held by a court of competent jurisdiction to be contrary to law, then such provision(s) shall be construed, as nearly as possible, to reflect the intentions of the parties, with the other provisions remaining in full force and effect.
ALL CARRIAGE IS OFFERED BY CITYJET LIMITED IN ACCORDANCE WITH THE CONDITIONS OF CONTRACT AS SET OUT BELOW AND SUBJECT TO CITYJET'S GENERAL CONDITIONS OF CARRIAGE FOR PASSENGERS AND BAGGAGE FROM TIME TO TIME IN FORCE.
Cityjet Conditions of Contract
1. As used in this contract 'ticket' means the document issued by carrier entitled 'Itinerary/Receipt'; 'carriage' is equivalent to 'transportation'; 'carrier' means Cityjet Limited, Swords Business Campus, Swords, Co. Dublin, Ireland; 'Warsaw Convention' means the Convention for the Unification of Certain Rules Relating to International Carriage by Air signed at Warsaw, 12th October 1929, or that Convention as amended at The Hague, 28th September 1955, whichever may be applicable.
2. Carriage hereunder is subject to the rules and limitations relating to liability established by the Warsaw Convention, unless such carriage is not 'International Carriage' as defined by that Convention.
3. To the extent not in conflict with the foregoing, carriage and other services performed by carrier are subject to: (i) provisions contained in the ticket, (ii) applicable tariffs and (iii) carrier's conditions of carriage and related regulations which are made part hereof and are available on application at the offices of carrier.
4. Except as the Convention or other applicable law may otherwise require, carrier shall not be liable for any death wounding or bodily injury or claim of whatsoever nature other than death or bodily injury arising from the negligence of carrier, its servants or agents arising out of or in connection with carrier or other services performed hereunder and the passenger hereby agrees for himself, his personal representative(s) and dependants(s) to waive all rights of claim against carrier and discharges carrier its servants and agents for any such claim as aforesaid.
5. Carrier's name may be abbreviated. The agreed stopping places are those shown in carrier's timetables as scheduled stopping places on the passenger's route.
6. Any exclusion or limitation of liability of carrier shall apply to and be for the benefit of agents, servants and representatives of carrier and any person whose aircraft is used by carrier for carriage and its agents, servants and representatives.
7. Checked baggage will be delivered to the bearer of the baggage identification tag. In case of damage to baggage moving in international transportation, complaint must be made in writing to carrier forthwith after discovery of damage and, at the latest, within 7 days from receipt; in case of delay, complaint must be made within 21 days from the date the baggage was delivered.
8. Ticket is good for carriage as provided in the ticket, in carrier's tariffs, conditions of carriage and/or related regulations and subject to payment of carrier's administration and other charges in respect of any change of flight details by the passenger, as specified by the carrier's conditions of carriage. The fare for carriage hereunder is subject to change prior to commencement of carriage. Carrier may refuse transportation if the applicable fare has not been paid. Carrier may also refuse transportation to any person who has made a booking and/or acquired a ticket in violation of applicable law or carrier's tariffs, rules or regulations.
9. Carrier undertakes to use its best efforts to carry the passenger and baggage with reasonable dispatch but times shown on the ticket, in timetables or elsewhere are not guaranteed and form no part of this contract. Carrier may without notice substitute alternate carriers or aircraft, and may alter or omit stopping places shown on the ticket in case of necessity. Schedules are subject to change without notice. Carrier assumes no responsibility for making connections.
10. Passenger shall comply with Government travel requirements, present exit, entry and other required documents and arrive at airport and boarding gate by time fixed by carrier or, if no time is fixed, early enough to complete departure procedures.
11. No agent, servant or representative of carrier has authority to alter, modify or waive any provision of this contract.
NOTICE OF GOVERNMENT IMPOSED TAXES AND FEES AND CHARGES
The amount paid for this ticket may include taxes, fees and charges which are imposed on air transportation by government and airport authorities. These taxes, fees and charges, which may represent a significant portion of the cost of air travel, are shown separately on the ticket. You may also be required to pay taxes, fees and charges not already collected.
NO SHOW PASSENGERS AND OVERBOOKING
(Not applicable to tickets sold in the United States for transportation originating in the United States.) On most flights, a proportion of passengers holding confirmed seats do not actually use their reservations. These passengers are known as "no-shows". If you know that you will not be able to travel on a flight on which you have a booking, please let us know as early as possible so that we can offer the seat to another passenger. One day you may be the passenger needing a reservation on an already fully booked flight. All carriers have to minimize the negative effect of "no-shows". That is why they may be compelled to overbook their services by a few seats in order to enable more passengers to travel on their chosen flight. Whilst Cityjet makes every effort to provide seats for which confirmed reservations are have been made, no absolute boarding guarantee may be provided. That is why in accordance with existing regulations, Cityjet operates compensation schemes for passengers with confirmed reservations who are denied carriage. Details of these schemed are available at Cityjet offices and airports.
NOTICE OF BAGGAGE LIABILITY LIMITATIONS
Liability for loss, delay or damage to baggage is limited unless a higher value is declared in advance and additional charges are paid. For most international travel (including domestic portions of international journeys) the liability limit is approximately US\$20.00 per kilo (\$9.07 per pound) for checked baggage and US\$400.00 per passenger for unchecked baggage. Liability for fragile, valuable or perishable articles may be limited or excluded
DANGEROUS ARTICLES IN BAGGAGE
For safety reasons, dangerous articles, such as those listed below, must not be carried in passengers' baggage.
- Compressed Gases (deeply refrigerated, flammable, non-flammable and poisonous) such as butane, oxygen, liquid nitrogen, aqualung cylinders and compressed gas cylinders
- Corrosives such as acids, alkalis, wet cell batteries and apparatus containing mercury (e.g. thermometers)
- Explosives, munitions, ammunition (including blank cartridges), hand guns, fireworks, flares and pistol caps
- Flammable liquids and solids such as lighter fuel, matches, paints, thinners, firelighters
- Radioactive materials
- Brief cases and attaché cases with installed alarm devices. · Oxidising materials such as bleaching powder and peroxides. · Poisons and infectious substances such as insecticides, weed-killers and live virus materials
- Other dangerous articles such as magnetised material, offensive or irritating substances
- Medicines and toiletries in limited quantities, which are necessary or appropriate for the passenger during the journey, such as hairsprays, perfumes and medicines containing alcohol, may be carried.
N.B. Toy or replica guns (plastic or metal), catapults, cutlery, razor blades (both open bladed and safety razors), tradesmen's tools which would have the potential to be used as a weapon, darts, scissors, hypodermic syringes (unless required for genuine medical reasons), knitting needles, large sporting bats and clubs, billiard, snooker or pool cues and any other sharp objects and weapons are not permitted in the cabin of our aircraft.
ADVICE TO INTERNATIONAL PASSENGERS ON LIMITATION OF LIABILITY
If your journey involves a destination or stop in a country other than the one from which you depart, the Warsaw Convention may govern the liability of all airlines involved in your journey, including any portion thereof within a single country. This convention limits the liability of airlines for death or bodily injury and for baggage loss, delay or damage. However, in the event of an accident resulting in the death or injury of a passenger whilst on a flight operated by Cityjet or a European Community air carrier, the amount of damages payable is not subject to any financial limit unless the carrier concerned can prove that the damage was wholly or partially due to the negligence of the deceased or injured passenger. For damages in excess of 100,000 Special Drawing Rights (approx. 140,000 Euro) Cityjet or such European community air carrier may be exonerated if it can prove that it and its agents had taken all necessary measures to avoid the damage or that it was impossible for it or them to take such measures. In addition, in cases of death of bodily injury, Cityjet and other European Community air carriers will make prompt advance payments to the person entitled to compensation, if required to meet immediate economic needs, in proportion to the hardship suffered and not less than 15,000 Special Drawing Rights (approx. 21,000 Euro) in the event of death.

Terms & Conditions
Internet Bookings Use of the Cityjet online booking facility is currently only available for services operated to Malaga.
Online bookings may be made for a total of up to nine (9) passengers provided that all passengers, including the credit card holder, travel as part of the same booking.
Provisional Booking and Reservations
The Cityjet online booking engine does not permit provisional bookings or hold reservations. It is solely for the purposes of booking and purchase of flights.
Fare rules
All listed fares are subject to certain conditions. By booking online the applicable fare rules associated with a particular ticket will be made available once you have chosen your travel dates and completed your personal details and before you are asked to make payment.
Cityjet strongly recommend that all passengers read the fare rules for each chosen fare carefully.

Changing and cancelling your booking
Should you be required to make a change to or cancel a booking made online please contact the Cityjet Head Office. Please see the Contact Us section of the site for details. Depending on the conditions applicable to the fare you purchased, changes to or cancellation of your ticket may not be permitted or a change/cancellation fee may apply.
Your credit card
A credit card is required to make a booking on the Cityjet site. We currently accept Visa, Mastercard, American Express and Diners. Your credit card will be accepted for charge when you click the "Confirm" on the "Trip Plan" page. At that time, your billing address is verified and your tickets are sent for processing.
All online transactions are protected by SSL technology and at no time is any credit card number stored on our website or in our airline database.
No more than five (5) bookings can be made in any one day using the same credit card.
Ticket Issue Method
Tickets will be posted to the address indicated at the time of booking, if a booking is made at least seven (7) days before the date of travel. Within seven (7) days of departure tickets will be made available for collection at the Cityjet Handling Ticket Desk. Passengers will be required to give a reservation reference number upon ticket collection.
Tickets for departures from Malaga will be available for collection from the Air France Ticket Desk located in the International Departures Terminal. Passengers will be required to give a reservation reference number upon ticket collection.
